Indian Independence Movement Essay

The Constitution of India is the Supreme Law of India. It lays down the framework defining fundamental political principles, establishes the structure, procedures, powers, and duties of government institutions, and sets out fundamental rights, directive principles, and the duties of citizens. It is the longest[ written constitution of any sovereign country in the world, containing 448 articles in 22 parts, 12 schedules and 97 amendments. Besides the English version, there is an official Hindi translation. Dr B.R. Ambedkar is widely regarded as the father of the Indian Constitution. The Constitution was enacted by the Constituent Assembly on 26 November 1949, and came into effect on 26 January 1950. The date 26 January was chosen to commemorate the Purna Swaraj declaration of independence of 1930. With its adoption, the Union of India officially became the modern and contemporary Republic of India and it replaced the Government of India Act 1935 as the country’s fundamental governing document. The Constitution declares India to be a sovereign, socialist, secular, democratic republic, assuring its citizens of justice, equality, and liberty, and endeavours to promote fraternity among them. The words â€Å"socialist† and â€Å"secular† were added to the definition in 1976 by constitutional amendment.[ India celebrates the adoption of the constitution on 26 January each year as Republic Day | Background Main article: Indian independence movement The major portion of the Indian subcontinent was under British colonial rule from 1757 to 1947. The impact of economic, political and social exploitation during this period helped the gradual rise of the Indian independence movement to gain independence from foreign rule. The movement culminated in the formation of the Dominion of India on 15 August 1947, along with the Dominion of Pakistan. The Constitution of India was adopted on 26 November 1949 and came into effect on 26 January 1950, proclaiming India to be a sovereign, democratic republic. It contained the founding principles of the law of the land which would govern India after its independence from British rule. On the day the constitution came into effect, India ceased to be a dominion of the British Crown. The Indian constitution is the world’s longest constitution. At the time of commencement, the constitution had 395 articles in 22 parts and 8 schedules. It consists of almost 80,000 words and took 2 years 11 months and 18 days to build. In the United Kingdom the office of the Secretary of State for India was the authority through whom Parliament exercised its rule (along with the Council of India), and established the office of Viceroy of India (along with an Executive Council in India, consisting of high officials of the British Government). The Indian Councils Act 1861 provided for a Legislative Council consisting of the members of the Executive council and non-official members. The Indian Councils Act 1892 established provincial legislatures and increased the powers of the Legislative Council. Although these Acts increased the representation of Indians in the government, their power still remained limited. The Indian Councils Act 1909 and the Government of India Act 1919 further expanded participation of Indians in the government. Government of India Act 1935 Main article: Government of India Act 1935 The provisions of the Government of India Act 1935, though never implemented fully, had a great impact on the Constitution of India. Many key features of the constitution are directly taken from this Act. The federal structure of government, provincial autonomy, a bicameral central legislature consisting of a federal assembly and a Council of States and the separation of legislative powers between the centre and states are some of the provisions of the Act which are present in the Constitution of India. The Cabinet Mission Plan Main article: 1946 Cabinet Mission to India In 1946, British Prime Minister Clement Attlee formulated a cabinet mission to India to discuss and finalize plans for the transfer of power from the British Raj to Indian leadership as well as provide India with independence under Dominion status in the Commonwealth of Nations.[6][7] The Mission discussed the framework of the constitution and laid down in some detail the procedure to be followed by the constitution drafting body. Elections for the 296 seats assigned to the British Indian provinces were completed by August 1946. The Constituent Assembly of India first met and began work on 26 November 1946. The mission consisted of Lord Pethick-Lawrence, the Secretary of State for India, Sir Stafford Cripps, President of the Board of Trade, and A. V. Alexander, the First Lord of the Admiralty. However, Lord Wavell, the Viceroy of India, did not participate. Indian Independence Act 1947 Main article: Indian Independence Act 1947 The Indian Independence Act, passed by the British Parliament on 18 July 1947, divided British India into two new independent states, India and Pakistan, which were to be dominions under the Commonwealth of Nations until they had each finished drafting and enacted a new constitution. The Constituent Assembly was divided into two for the separate states, with each new Assembly having sovereign powers transferred to it for the respective dominion. The Act also terminated British suzerainty over the princely states, each of which was left to decide whether to accede to one or other of the new dominions or to continue as independent states in their own right. However, in most cases the states were so dependent on central institutions that they were widely expected to accede to a dominion. When the Constitution of India came into force on 26 January 1950, it repealed the Indian Independence Act. India ceased to be a dominion of the British Crown and became a sovereign democratic republic. 26 November 1949 is also known as National Law Day. Constituent Assembly Main article: Constituent Assembly of India The Constitution was drafted by the Constituent Assembly, which was elected by the elected members of the provincial assemblies.[8] Dr B.R. Ambedkar, Sanjay Phakey, Jawaharlal Nehru, C. Rajagopalachari, Rajendra Prasad, Sardar Vallabhbhai Patel, Kanaiyalal Munshi, Purushottam Mavalankar, Sandipkumar Patel, Maulana Abul Kalam Azad, Shyama Prasad Mukherjee, Nalini Ranjan Ghosh, and Balwantrai Mehta were some important figures in the Assembly. There were more than 30 members of the scheduled classes. Frank Anthony represented the Anglo-Indian community, and the Parsis were represented by H. P. Modi. The Chairman of the Minorities Committee was Harendra Coomar Mookerjee, a distinguished Christian who represented all Christians other than Anglo-Indians. Ari Bahadur Gururng represented the Gorkha Community. Prominent jurists like Alladi Krishnaswamy Iyer, Benegal Narsing Rau and K. M. Munshi, Ganesh Mavlankar were also members of the Assembly. Sarojini Naidu, Hansa Mehta, Durgabai Deshmukh, Rajkumari Amrit Kaur and Vijayalakshmi Pandit were important women member Dr. Bhimrao Ramji Ambedkar is hailed as the prime architect of Indian Constitution The first temporary 2-day president of the Constituent Assembly was Dr Sachidanand Sinha. Later, Rajendra Prasad was elected president of the Constituent Assembly. The members of the Constituent Assembly met for the first time on 9 December 1946. Independent India India acquired independence on 15 August 1947 though sections of the country were carved out and stitched together to create another new country, Pakistan. The â€Å"institutional† road to independence was perhaps laid down by the Government of India Act of 1935, where the gradual emergence of India as a self-governing entity had first been partly envisioned. Following India’s independence in 1947, the Constituent Assembly deliberated over the precise constitutional future of India. On 26 January 1950, India became a Republic, and the Constitution of India was promulgated. Jawaharlal Nehru had become the country’s first Prime Minister in 1947, and in 1952, in the country’s first general election with a universal franchise, Nehru led the Indian National Congress to a clear victory. The Congress had long been the principal political party in India, providing the leadership to the struggle for independence, and under Nehru’s stewardship it remained the largest and most influential party over the next three decades. In 1957, Nehru was elected to yet another five-year term as a member of the Lok Sabha and chosen to head the government. His ‘regime’ was marked by the advent of five-year plans, designed to bring big science and industry to India; in Nehru’s own language, steel mills and dams were to be the temples of modern India. Relations with Pakistan remained chilling, and the purported friendship of India and China proved to be something of a hoax. China’s invasion of India’s borders in 1962 is said to have dealt a mortal blow to Nehru. Nehru was succeeded at his death on 27 May 1964 for a period of two weeks by Gulzarilal Nanda (1898-1998), a veteran Congress politician who became active in the non-cooperation movement in 1922 and served several prison terms, principally in 1932 and from 1942-44 during the Quit India movement. Nanda served as acting Prime Minister until the Congress had elected a new leader, Lal Bahadur Shastri, also a veteran politician who came of age during the Gandhi-led non-cooperation movement. Shastri was the compromise candidate who, perhaps unexpectedly, led the country to something of a victory over Pakistan in 1965. Shastri and the vanquished Pakistani President, Muhammad Ayub Khan, signed a peace treaty at Tashkent in the former Soviet Union on 10 January 1966, but Shastri barely lived to witness the accolades that were now being showered upon him since he died of an heart attack the day after the treaty was signed. Shastri’s empathy for the subaltern classes is conveyed through the slogan, â€Å"Jai Jawan, Jai Kisan†, â€Å"Hail the Soldier, Hail the Farmer†, which is attributed to him and through which he is remembered at Vijay Ghat, the national memorial to him in New Delhi in the proximity of Rajghat, the national memorial to Mohandas Gandhi.

Before a marriage is fully â€Å"matured† 3 out of 10 fail and resort in a divorce. No child want’s to hear the word divorce mentioned by their parents, little alone the other spouse. Many now a days seek divorce as an â€Å"easy way out,† given that they have an annulment. Some may even cheat the system and get married for the spouses money, title, or objects. The marriages that are there just for show, don’t tend to last as long and become unhappy. In a marriage anything can go wrong from bad communication, cheating, and abuse. Fyodor Dostoyevsky, once a Russian novelist said, â€Å"much unhappiness come into the world because of bewilderment and things left unsaid.† The number one reason marriages end is because of the lack of communication in the relation, according to Huffington Post. There are five main instances where a lack of communication can affect the marriage. The first one, is hiding your feelings. If you’re having a heated conv ersation with your spouse but keeping in feelings or problems then where is your relationship going to go? Oh I can help, nowhere. The next type is bodily or physical. Simply rolling your eyes, walking away from the conversation, shrugging your shoulder, or even the lack of eye contact can push someone away. A â€Å"win-lose attitude† is one of the most aggravating things for someone to do, personally. If someone always says, â€Å"it wasn’t me,† if they’re judgemental or a very negative person it can agitate you and even bring you down. Lastly a lack of politeness can make someone feel underappreciated. If you continuously do something for someone and they correspond in a uncaring manner you will tend to feel over time like you don’t matter. The simple command, like â€Å"take the dog out,† can seem abrasive. They’re no such thing as over kindness, if someone does something nice for you, you can just simply correspond with a â€Å"thank you.† â€Å"Thank you honey,† any house wife, or husband would love to hear of their spouse. Just by keeping the à ¢â‚¬Å"spark† between you and your spouse lite can help keep them interested in you, instead of others. Infidelity is the cause for 53% of a divorce. Only 31% of marriages last after a cheating incident, and a whopping 53% of relationships are cheated. Isn’t it ironic though how psychiatrists and marriage counselors are the top two professions for the divorce rate. you would think since they work with helping marriages, that they’d have a lower chance, I guess not in this case. Many events can lead to infidelity. After the first year in the marriage there is the same  habitual activities every day where the cheater may feel like they need something new in life, which is when someone may first turn to cheat. Having a child is a huge factor, it’ll affect the relationship no matter what you have done. The stress of having to completely care for another human being can affect you mentally, and some feel like they want to go out and have an adventure, but they turn to the wrong activity when that happens. When it comes to the 5th to 7th year, also known as â€Å"the seven year itch.† By this time most coup les may have obtained the â€Å"american dream,† but they start to become bored and unhappy, so they turn to something new, to change things up. Then there’s the mid-life crisis. Generally around this time you’ve spent 20 years with the person, but you’re just not quite sure that another 20 you want to be with the person. These instances are generally the reasons which fuels someone to cheat. It’s not always the case, but these are the times when infidelity is started. Just picture 5 million women, which is just a quarter of women in a marriage. That mere 25% is the percentage of women that have been in a abusive relationship. There’s six different way abuse can happen, the following are: physical, emotional, verbal, economic, mental, and sexual.Why do they do it? They seek to control their spouse. Emotional, mental, and verbal is generally how it starts, but then it can progress to sexual and economic. It can be hard for These types of abuse though don’t always pertain to the spouse, it could be happening to a child or children of the couple. To say divorce only affects the two joined in holy matrimony is an unstatement. The children, friends, family, everyone thats connected to the two can be effected. As a child that has divorced parent, since I was two, can say it still affects me. I have to figure out a time during break when I can go that doesn’t conflict too much with my sports, I barely get to see my dad, and it’s hard to see my mom work and earn all of the money, by herself for us. So if you don’t want your marriage to end try to keep good communication a priority, whatever you do don’t cheat, and be sure to check if you’re being or are abusive, so you can get help to work on it. At present Gambling is in the ‘underground economy’ mark when it comes to calculating the unemployment rate. Since it’s illegal workers are considered to be employed, however legally they’re counted as unemployed when it comes to the unemployment rate. In an article written by Olivia Saunders, Saunders illustrated the unemployment rate in a diagram that showed an unemployment rate of 7. 8 percent. Out of this 7. 8 percent count are the people that are already presently working for number houses, if we legalize gambling that rate would automatically decrease. Many are lead to believe that legalizing gambling won’t decrease the unemployment rate, because there are already a substantial amount of lottery houses opened already and there are still many unemployed, it’s impossible for this to help our unemployed, and even if it does, it won’t completely take care of the problem. They are partially right because legalizing gambling won’t lead to a complete decline in the unemployment rate, and it won’t be able to employ everyone without a job, however they are misguided because it will help tremendously. Therefore they’ll need more staff, this will also lead to more casinos and more people will be hired in many different aspects. For example they’ll need cleaners, cashiers, coupe and hostesses. The real truth is there are many different aspects in our economy that contributes to the unemployment rate both increasing and decreasing and this rate can never be steady. However once gambling is legalized and there are more venues opened then it’s a necessity to hire people to work in them, and these people will then count towards the unemployment rate and it’ll then decrease. Finally the legalization of gambling can be used as a sport and a form of entertainment. The only form of gambling is not purchasing numbers from the lotto shops as some Bahamians are blindsided to believing, however it is also a sport. There was once a horse racing venue that was used as a sport over here in 1976 but had to leave because gambling wasn’t legal. Legalizing gambling would allow this form of entertainment to once again be practiced. In a journal named ‘Gambling The cost of our future,’ it indicates that ‘Those who participate in gambling activities do so voluntarily and, in return, receive intrinsic benefits from their consumption. This statement raises a thoughtful argument because gambling is indeed a risk however this risk is on the same level of buying a cinema ticket and you’re not sure if the movie will play or a symphony and you’re not sure if you’ll enjoy it. Opponents believe that having gambling as sports can only lead to more financial problems for an unstable financial home. They may argue that gambling is an addictive game and some families aren’t ready for the strain that this addiction entails, and some people may be willing to do anything to satisfy this addiction like commit robbery. But they are misguided because this entertainment and sport may not be addictive but relatively fun and exciting and a good family event for most, even though there may be some bad apples the pros may outweigh the cons. The real truth is that almost everything we do as a form of gaming exercise is pleasurable and having more opportunities will make gambling more enjoyable. The Government can also implement a system so that gamblers that develop the addiction can be fully taken care of and receive psychiatric help called Gamblers Anonymous’ (GA). According to the the 12 step recovery program statistics â€Å"Of those in their fourth month of AA meeting attendance (i. e. have stayed beyond 90-days) 56% will still be attending AA at the end of that year. † (Holding all others constant if this system is practiced here with addicts treatment will be beneficial. In conclusion, gambling can contribute to our economy significantly. This focus and previous research conclusions will be included in the chapters of the store image where the variables are integrated. 2.1 Consumer Behavior in Malaysia Malaysias consumer lifestyle has been evolving and changing due in part to rising affluence and education levels. High profile international retailers and the global mass media have also played a hand in shaping consumer-buying behavior. Malaysians are becoming more westernized, sophisticated and cosmopolitan. Malaysians spend a high percentage of their household income on food, groceries and personal care items, ranking third out of the ten major economies in the Asia-Pacific region (excluded Japan). According to ACNielsen, Malaysians on average spent MYR505 per month on food and groceries, with just under half of that on fresh food like meat, fruits and vegetables. Since the emergence of the foreign-owned hypermarkets, Malaysians who live in urban areas have become accustomed to shopping for groceries at hypermarkets and supermarkets. Meanwhile rural people continue to purchase from traditional grocers, convenience stores and mini-marts. High and middle-income households spend most of their money at hypermarkets, followed by supermarkets and traditional grocery stores. The high-income group has household income of more than MYR3500 per month. 2.2 Retail Store Growth and Evolution Large-size store becomes a trend in the global. Hypermarkets are one of the manifestations of organized retailing. Srivastava (2008) observes that organized retailing, globally, has played a major role in nations GDP and employment. According to Srivastava, the ratio (composition) of organized versus traditional retailing is increasing in countries such as the US (85:15), Taiwan (81:19), Malaysia (55:45), Thailand (40:60), Indonesia (30:70), China (20:80), and India (3:97). The data in parenthesis describes the organized versus traditional ratio of retailing for each country. Offering large premises with both food and non-food items, everyday low prices (EDLP), and large car parks; the hypermarket format has been in existence for more than 35 years since the inauguration of Carrefour (the first French hypermarket) on 15 June 1963 (Roberts, 2005). The phenomenal success of hypermarkets in France affected other formats so adversely that certain legal restrictions were imposed on them. To counter the restrictions, the internationalization of French hypermarkets began in the 1970s, when Carrefour went global to countries such as Spain, Brazil and Argentina (Roberts, 2005). Carrefour along with other leading French chains such as Euromarche, Auchan and Leclerc subsequently marked their presence in the US market too between 1985 and 1993 (Roberts, 2005). The evolution of hypermarkets was quite revolutionary and their growth rate far surpassed the traditional formats in different parts of the world. In Spain, the number of traditional outlets dedicated to the retail food business fell by almost 50% between 1980 and 1995, where hypermarkets and supermarkets multiplied 6 and 11 respectively during that period (Flavian and Polo, 1998). In a similar manner, Taiwans traditional farmers markets disappeared at rates between 3-5% per year with the opening of at least 100 new supermarkets and 50 new hypermarkets all over Taiwan between 1988 and 1996 (Chang and Tu, 2005). Supermarkets and hypermarkets almost doubled to 941 from 544 in the Czech Republic too, in a time span of seven years, acquiring 55% of total retail sales (Healey Baker, 2002). 2.3 Store Formats 2.3.1 Hypermarket Hypermarket has clearly emerged as one of the most important retailing entity in most countries, offsetting the traditional and supermarket (Barros, 2006). Malaysian had her first hypermarkets opened for business in 1994. According to the Economic Transformation Programme announced in October 2010, Malaysia has 121 hypermarkets, included Giant, Tesco, Carrefour, Mydin. The general rule for one hypermarket is for every 250,000 people. The evolution of the various retail formats, in one way or the other, customers benefit by having greater access and choice. The concept of all the items under one roof has been submitted to different customers and have brought some changes in their preferences and behavior. With the presence of hypermarkets, customer expectations have changed and their importance to the acquisition have been affected (Oruc N, 2005); Terblanche and Boshoff, 2004; Vignali et al., 2001). Expectations and preferences, was different in different cultural environments, the study aimed to study the perceptions of consumers and their preferences on the store image of traditional wet markets and hypermarkets. 2.3.2 Traditional Wet Market A traditional wet market is an open food market, it is also called as traditional market (Wordie, 2002). The main features of the market have been traditionally associated with a place that sells live animals. The raw meat may include poultry, fish, reptiles, and so on. Depending on the region, the animals are usually caged and killed for the preparation. Fresh fruits and vegetables are also available. Wet markets usually include butchers and fish markets, which are in a separate section of the fruit and vegetable stalls. The highest hygiene standards of supermarkets have forced many traditional markets to operate in the interior. In general, the owner of a wet market, owns and maintains the building. The stalls are rented to retailers, who buy and sell their products independently. This is in contrast to a hyper store operated by a single company. In 2011, a total of 23 traditional wet markets and 3075 stalls inside the traditional wet markets in Penang Island are belong to Penang Municipal Council (Majlis Perbandaran Pulau Pinang, MPPP). 2.4 Store image Store image can be described as a concept of the way of consumers see a store in their mind, regarding touchable or untouchable attributes. It is a way of the store being defined in the consumers mind, partly is functional qualities of the store and partly is the atmosphere of psychological attributes of the store (Martineau, 1958). The store image will affect the shoppers buying behavior and this was a conceptualization with included store attributes by the researchers (James et. Al, 1976). Besides that, store image is also described as the concept of combination of consumers or shoppers perceptions of a store on different attributes (Bloemer and Ruyter, 1998). There are several researchers ever tried to identify the store attributes as these are the foundation of the overall image of the store. According to Lindquist (1974), store image have 9 elements, included vending, consumer, facilities, service, comfort, promotion, atmosphere, institutional and post transaction satisfaction. Later on, Doyle and Fenwick (1974) simplified and categorized the store image to 5 elements: price, product, variety, styling and location. While addition attributes of parking facilities and friendly personnel has been put forward by Bearden (1978). According McGoldrick (1990), the image is the indicator of the asset value of the branding, it corresponds with the long-run result of retailing activities. The understanding of the relationship between image and buying behavior of consumers are very important for better strategies in attracting consumers. 2.5 Consumers perception On Store Image 2.5.1 Variety of Goods The main attraction of the retail store is the trading of the goods. According Lindquist (1974), the main components of trading goods are quality, variety and selection of the goods. The stores which provide variety of goods will never lose its attraction. According Golledge et al. (1966), assortment or variety of the goods offers shoppers with more choices and enhances the ability of the stores to satisfy their needs. This makes them unnecessary to visit different stores to fulfill their needs. Based on this reason, a large size of stores such as supermarket or hypermarket has advantage in the retail sector, this kind of store able provide variety choice to consumers and makes them has benefit in reducing their time in visiting different stores (Huff, 1962). Thus, the stores which are able to provide variety and assortment of goods and services have their advantage to attract more consumers and to be preferred by the consumers as well. 2.5.2 Store Atmosphere Atmospheric of a retail store is a very important element. Atmospherics of retail store is the effort to design retail environments to produce specific emotional effects in the consumer that enhance his buying probability (Kotler, 1974). Ghosh (1994) found that atmospherics of store refers to the environment that is brought about by a coordinated visual display of goods and the ease of accessibility and mobility within the retail store. Moreover, Donovan and Rossiter (1982) assert that the physical surrounding will produce an emotional reaction and directly affected the consumers buying behavior. Thus, atmospheric of store becomes a strategy of the retailers, providing a favorable environment with spacious space, clean and comfortable, lighting and so on to affected shopping behavior of consumers. Thus, the quality of service has great affected to the consumers buying behavior (Shycon, 1992). At first all of the little boys come together and work together to figure out what they are going to do and how they are going to handle things. They are civilized little English school boys in the beginning. They go around and find out what everyone's name is. They get together in a meeting and vote a young boy named Ralph as the leader. Ralph is a quiet and well mannered little boy and he looks out for the best of everyone. Ralph believes in decency and civilization. Ralph has a follower nicknamed Piggy. Piggy is an overweight smart little kid. Ralph makes up rules like only one person talking at once and you have to raise your hands. Things like this that keeps order in the group. Piggy always backs Ralph up on his decisions. Things go well for a while, until they start believing that there is a beast that is on their island and is after them. The civilizations starts to change when Jack, a snotty sarcastic kid, takes a group to hunt for the beast. They start killing pigs and eating the meat. Things start to get out of control and they begin to paint their faces and sharpen spears. So, the group gets divided because more boys start to follow Jack because they have food even though they are crazy. Jack's group accidentally kills Simon, one of the younger boys. Piggy sticks with Ralph the whole time, even when they were the only ones left with some decency. Jack and his friends come and steal Piggy's glasses to start a fire and this makes Ralph mad. Ralph and Piggy go to regain Piggy's glasses and Jack's tribe makes a huge boulder fall on Piggy. They killed him. This leaves Ralph as the last one left. So Jack's tribe hunts him. They chase him all through the jungle and then onto the beach. Ralph stumbl es and falls right onto a man with white pants and bright white shoes.
